1. Who We Are 1.1 ScrapMyCar.net (“ScrapMyCar”, “we”, “us”, “our”) is an online lead generation and vehicle introduction platform. 1.2 We are not a vehicle purchaser, motor trader, scrap yard, Authorised Treatment Facility (ATF), or recycling operator. 1.3 We operate solely as an introductory service connecting vehicle owners (“Sellers”) with independent third-party vehicle buyers, scrap dealers, and collection agents (“Buyers”). 1.4 We do not purchase vehicles, take ownership of vehicles, collect vehicles, process vehicle paperwork, or make payments to Sellers. 2. Nature of Our Service 2.1 Our website provides: An online valuation estimate tool. Introduction of Seller details to one or more independent Buyers. 2.2 Any valuation displayed is: An estimate only. Not a legally binding offer. Provided for guidance purposes only. 2.3 We do not guarantee: That any Buyer will make an offer. That a vehicle will be collected. That a specific price will be achieved. 2.4 We do not act as agent for the Seller or the Buyer unless expressly stated in writing. 2.5 We are not a party to any contract for the sale, purchase, or disposal of a vehicle. 3. Contract Formation 3.1 Any agreement for the sale, transfer, disposal, or purchase of a vehicle is strictly between: The Seller and the independent Buyer. 3.2 ScrapMyCar is not: A principal in the transaction. An agent authorised to bind either party. Responsible for performance of any agreement between Seller and Buyer. 3.3 By proceeding with a collection or sale, the Seller acknowledges that: ScrapMyCar is not the purchaser of the vehicle. ScrapMyCar does not assume legal title at any stage. 4. Responsibility for Vehicle Transfer & DVLA Notification 4.1 Responsibility for properly transferring vehicle ownership and notifying the DVLA rests solely with: The Seller and/or The Buyer collecting the vehicle. 4.2 ScrapMyCar: Does not complete DVLA documentation. Does not notify DVLA of keeper changes. Does not issue Certificates of Destruction. Does not assume liability for fines, toll charges, penalties, or enforcement action arising from failure to correctly transfer ownership. 4.3 Sellers are strongly advised to: Retain written proof of collection. Complete and submit DVLA keeper transfer notification immediately upon collection. 5. Independent Buyer Status 5.1 Buyers introduced through our platform are independent businesses. 5.2 ScrapMyCar: Does not control their operations. Does not supervise collections. Does not guarantee their conduct. Does not warrant their compliance with legal obligations. 5.3 We may remove Buyers from our network at our discretion. 5.4 Nothing in these terms creates: A partnership A joint venture An agency relationship Employment 6. Payments 6.1 ScrapMyCar does not process, handle, or guarantee payments between Buyer and Seller. 6.2 Payment arrangements are agreed solely between the Seller and Buyer. 6.3 We accept no liability for: Non-payment Underpayment Payment delays Method of payment Fraudulent activity by third parties 7. Complaints & Disputes 7.1 Any dispute relating to: Vehicle condition Payment Collection conduct Fines Tolls Parking penalties DVLA notifications Post-collection use of the vehicle must be raised directly with the Buyer. 7.2 ScrapMyCar may, at its discretion, facilitate communication but has no obligation to resolve disputes. 7.3 We are not liable for losses arising from disputes between Seller and Buyer. 8. Limitation of Liability 8.1 To the fullest extent permitted by law, ScrapMyCar excludes liability for: Any loss arising from vehicle sale transactions. Parking fines or toll charges. DVLA penalties. Enforcement action. Bailiff action. Loss of profit. Consequential or indirect losses. 8.2 Our total liability for use of this website shall not exceed £100. 8.3 Nothing in these terms excludes liability for: Death or personal injury caused by negligence. Fraud or fraudulent misrepresentation. Any liability that cannot be excluded under English law. 9. Seller Warranties By submitting a vehicle through our platform, the Seller warrants that: They are the legal owner. The vehicle is not subject to finance unless declared. All information provided is accurate. The Seller agrees to indemnify ScrapMyCar against any loss arising from false or misleading information provided. 10. Buyer Responsibility & Indemnity 10.1 Buyers introduced via our platform operate independently and are responsible for compliance with: DVLA regulations Environmental legislation Consumer protection law Payment regulations 10.2 Buyers agree to indemnify ScrapMyCar against: Claims arising from vehicle transactions. Fines or penalties linked to vehicles collected. Consumer disputes. Regulatory investigations caused by Buyer conduct. (This clause should also be reinforced in your separate partner agreement.) 11. Website Use 11.1 The website content is for general information only. 11.2 We reserve the right to: Suspend or terminate access. Remove listings. Amend website content. 12. Data Protection Personal data is processed in accordance with our Privacy Policy. 13. Third Party Rights These terms do not create rights under the Contracts (Rights of Third Parties) Act 1999. 14. Governing Law & Jurisdiction 14.1 These Terms are governed by English law. 14.2 The courts of England and Wales shall have exclusive jurisdiction.
